Rules on Protection of Three Major Trademarks Effective as of June 1, 2003Since June 1, 2003, the Rules on Identification and Protection of Well-Known Trademarks, the Administrative Rules on Collective Trademarks Registrations, and the Enforcement Rules on Madrid International Trademark Registrations (trio of rules upholding trademark protection) have been formally brought into effect.

The implementation of the Rules on Identifications of Well-known Trademarks has provided a new interpretation of how well-known trademarks are to be protected. Certain popular trademarks, which were formerly regarded as an honor for a company to possess, are now being portrayed as weapons demanding legal protection. The identifications of these well-known trademarks will no longer be evaluated by the state governmental agencies.

As the Enforcement Rules on Madrid International Trademark Registrations takes effect, the working process for international registration will become a clearer, smoother process. Furthermore, the Administrative Rules on Collective Trademark Registrations will not prohibit the transferring of trademarks, and new regulations on qualification requirements for beneficiaries have also been issued.
